    DerrAI Terms of Service

    Welcome to DerrAI (“we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of DerrAI’s websites, applications, and AI services (collectively, the “Services”).
    By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

    1. Use of Services

    • You may use DerrAI Services only in compliance with these Terms and all applicable laws and regulations.
    • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
    • You agree not to misuse our Services, including attempting to access them using methods other than our provided interfaces or APIs.

    2. Intellectual Property

    • All content, software, models, and materials made available through DerrAI are the property of DerrAI or its licensors.
    • You retain ownership of your input data and any non-AI content you provide, but you grant DerrAI a limited license to process that data solely for the purpose of delivering the Services.

    3. Generated Content

    • DerrAI may generate text, images, audio, or video (“AI Outputs”) based on your inputs.
    • You are responsible for reviewing AI Outputs before using or publishing them. DerrAI does not guarantee accuracy, reliability, or legality of AI Outputs.
    • You agree not to use AI Outputs for unlawful, harmful, or deceptive purposes.

    4. Privacy and Data Handling

    • Your privacy is important to us. Our data practices are detailed in the DerrAI Privacy Policy and Ethical Policy.
    • By using our Services, you consent to our collection and use of data as described in those policies.

    5. Acceptable Use

    • You may not use the Services to:
      • Violate laws, regulations, or intellectual property rights.
      • Generate or distribute harmful, discriminatory, or misleading content.
      • Attempt to disrupt or gain unauthorized access to our systems or data.
      • Re-sell, repackage, or replicate the Services without written consent.

    6. Service Availability and Updates

    • We may update, suspend, or discontinue any part of the Services at any time without prior notice.
    • We may also modify these Terms when necessary. Material changes will be communicated through our website.

    7. Disclaimers and Limitation of Liability

    • The Services are provided “as is” without warranty of any kind. DerrAI disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.
    • DerrAI shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.
    • Our total liability for any claim under these Terms is limited to the amount paid by you (if any) for use of the Services in the preceding 12 months.

    8. Termination

    • We reserve the right to suspend or terminate access to the Services if you breach these Terms or misuse our systems.
    • Upon termination, your right to use the Services immediately ends.

    9. Governing Law

    • These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
    • Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in the State of California.
